The highest court of the judiciary thus definitively recognizes the guilt of the company in the Uber Pop case, a service which put individuals in contact with drivers and which was arrested in July 2015, after being placed in police custody. of two executives from Uber France.

In its decision, the Court of Cassation recalls that taxis are the only transport drivers who can circulate and park on public roads in order to find customers, and that all other drivers, VTC or others, have the right to obligation between two races to return either to the establishment which operates their vehicle, or to go to an authorized parking place, off the roadway.

Illegal exercise of taxi activity

The Court thus confirms that Uber France was indeed complicit in the illegal exercise of the taxi activity, the drivers of its Uber Pop service not being taxi drivers. “This decision only concerns the Uber Pop service, which connected passengers and amateur drivers and which we ended in 2015,” responded Uber France in a statement.

“Since then, Uber has fundamentally rethought its model, taking into account local expectations related to its operations. Only professional VTC drivers as well as taxi drivers can carry out their activity via the application,” added the company.

Leaders singled out

The French general manager at the time, Thibaud Simphal, and the former Western Europe director, Pierre-Dimitri Gore-Coty, were also definitively found guilty of deceptive commercial practices and complicity in the illegal exercise of activity of taxi operator and illegal organization of a system of putting customers in contact with people engaged in road transport.

Uber France and the two managers had filed appeals against a ruling by the Paris Court of Appeal which had sentenced them in January 2022 to fines: 800,000 euros including 400,000 suspended for the company, 20,000 euros including 10,000 suspended sentence for Thibaud Simphal and a fine of 30,000 euros including 15,000 euros suspended for Pierre-Dimitri Gore-Coty.

The Court of Cassation having partially annulled this decision of January 2022, a court of appeal will have to rule again on the sentences handed down against Uber France and the managers.
