The Union Home Ministry has decided to replace the 130-year-old British-era law followed in the prison sector across the country and introduce a new procedure with a modern approach.

From the norms followed in prisons across the country to the personal issues of inmates, there has been a long-standing demand for reforms.

Advice

At present, the ‘Prisons Act – 1894’ is in force in the country. All the laws contained in it were introduced during the British rule.

Due to these old practices, not only the prisoners but also the government, police and justice department are facing various problems.

In this case, as per the advice of the Union Home Minister Amit Shah, the officials of the Ministry of Home Affairs have been engaged in the work of changing the rules followed in the prison sector and making rules according to the modern times.

Subsequently, the Home Ministry officials have finalized the detailed legal procedures titled ‘Model Prisons Act – 2023’.

This new form of law, after 130 years, has evolved to include prisons, the inmates housed there, the prison officials and officers who maintain them.

Rules have been laid down to ensure complete transparency in the detention and handling of women, transgenders and children.

Norm

The regulations have also been updated with regard to issues including parole and punishments given to prisoners and wardens who use banned mobile phones.

The new regulations also ensure detailed contributions to the prisons department, including interrogating prisoners through ‘video conferencing’ and in-jail rehabilitation activities.
