Hundreds of traders have already paid the price all over France for the riots that have taken place every night since the death of Nahel in Nanterre, during a police check. With a loss that can quickly amount to tens of thousands of euros if we add to the damage the amount of the stolen goods.

But unlike motorists, a good half of whom are third-party insured and will not be able to claim coverage from their insurance in the event of a fire, traders are rather well off. “They are covered by a multi-risk professional insurance which is in a way the equivalent of a multi-risk home for individuals”, deciphers Olivier Moustacakis, co-founder of the comparator Assurland.com.

Thus, buildings for commercial use or belonging to municipalities (libraries, gymnasiums, town halls, etc.) are most often guaranteed against fire. The vandalism guarantee allows you to be compensated in the event of voluntary damage and the theft guarantee covers looting. But beware, “it does not play for objects stolen from outside buildings”, warns France Assureurs.

If the insurance does not cover damage to property, it is possible to apply to the Compensation Commission for Victims of Offenses (Civi) at each court of law. The Civi will forward the request to the Victims Guarantee Fund. In order to be compensated, your resources must not exceed 18,404 euros, an amount increased according to the number of dependents. The maximum amount of compensation that the merchant can receive in this context is 4,601 euros.

Shortfall

People who are unable to claim insurance can submit their claim to the prefecture on the basis of “Article L.211-10 of the Internal Security Code, which establishes liability without fault on the part of the State for damage caused by crowds or gatherings, specifies France Assureurs. However, it is up to the administrative judge to assess the conditions of application of this text. »

Beyond compensation for damage and stolen goods, there is also the question of the loss of earnings for traders if their store cannot reopen immediately, for example, the time to carry out work. “Traders can add an operating loss guarantee to their professional multi-risk, the premium of which is calculated on the basis of the turnover of the previous year”, specifies Olivier Moustacakis of Assurland.com. Problem: not everyone subscribes to it. “About half of traders and companies have this guarantee”, we are told at France Assureurs. The others will be out of pocket.
