Uttarakhand Chief Minister Introduces Single Person Act – Live-in Relationships Must Register with District Officials

Dehradun – Uttarakhand Chief Minister Pushkar Singh Dhami introduced the Single Person Act in the House. On the second day of the specially convened four-day legislative session, the Chief Minister introduced the Single Person Bill in the House. The draft bill was approved by the state cabinet. The opposition has demanded more time to study the bill. The bill will be debated in the House soon.

At the same time, with the coming into effect of the Single Person Act, discussions are also going on seriously about the possible changes in the personal laws of the state. The main thing is that once the law comes into effect, those in live-in relationships will also have to register their relationship. If under 21 years of age, parental consent is also required. There is also a requirement that the partner should be registered even if the partner is outside the state.

Registration shall not be granted for such relationships as are contrary to public law and morals, married but engaged in another relationship, minor partner, falsely consenting to a live-in relationship. A dedicated website will be launched to collect live in relationship information. The district registrar will scrutinize the information. The registrar may summon anyone, including partners, who may share information about the relationship to inquire further. Or if the registration is denied, the Registrar should send a letter stating the reason.

Once registered, a specially prepared letter must be given to cancel the registration. If the information contained in it is found to be unreliable, the police will conduct an investigation. If there are partners under the age of 21, the parents will be informed about it. Children born in any relationship like marriage, live-in relationship will get equal treatment in the state. There will be no term of illegitimate offspring. Children shall have equal rights in inheritance. A woman in a live-in relationship is entitled to ransom if her partner deserts her.

Failure to register the relationship or providing false information can result in a fine of Rs 25,000 and three months imprisonment for one or both of the partners. Even a month’s delay can result in jail time. Both partners will be fined 10,000.

The Single Person Act also mentions a complete ban on polygamy, child marriage, and stipulating a certain age for marriage for girls belonging to all religious groups. If the bill passes the House, Uttarakhand will become the first state in the country to implement the Single Person Act.
