The Administrative Court of Antioquia decreed the loss of investiture of Juan Carlos Upegui Vanegas. Upegui was in the Medellín Council after coming in second place in the October 29, 2023 elections.

The loss occurred due to the alleged inability to aspire to public office, because his father was appointed rector of a public school.

The Administrative Court of Antioquia said:

“Decrees the loss of investiture of councilor Juan Carlos Upegui Vanegas of the Special District of Science, Technology and Innovation of Medellín, designated for the constitutional period 2024-2027′′.

PFor his part, Upegui, reacted in his account of X, to the Court’s decision. He assured that the purpose of removing him from the Medellín Council is to eliminate opposition to Federico Gutiérrez.

In turn, he indicated that he will appeal the decision before the Council of State to defend his political rights.

“In the same sense as the Attorney General’s Office, the Administrative Court of Antioquia has decided that I will lose my investiture as a councilor of Medellín. The purpose is to eliminate opposition to Federico Gutiérrez. We will appeal to the Council of State to defend our political rights,” Upegui wrote in X.

The reasons for the lawsuit filed by the Transparency Electoral veeduría and councilor Andrés Rodríguez. They pointed out that Upegui’s father, Carlos Alberto Upegui Mejía, was appointed rector of an Educational Institution days before he registered his candidacy.

In that sense, This implies a disability, since he could not aspire to public office. Since, according to article 37 of Law 617 of 2000, His father could not hold a position in the previous 12 months, since he is a first-degree blood relative.

Finally, the lawsuit warned: “The institution is attached to the Secretary of Education of the Mayor’s Office of Medellín. That is, in the same municipality that the defendant was elected. Being a public educational establishment of a District nature, with administrative autonomy and independent assets.”
