Venezuela’s TSJ Electoral Society confirms the victory of Nicolás Maduro on June 28

The Electoral Chamber of the Supreme Court of Justice (TSJ) of Venezuela issued a ruling this Thursday in Caracas regarding the investigation of the controversial appeal filed by President Nicolás Maduro, related to the June 28 presidential elections.

Judge Caryslia Beatriz Rodríguez Rodríguez read the sentence. She was accompanied by judges Fanny Márquez and Inocencio Figueroa, members of the Electoral Chamber. Based on the results obtained in the expert opinion, Rodríguez Rodríguez confirmed that the bulletins of the results of the National Electoral Council (CNE) are in line with the reports from the election machines and the results aggregation centers.

Based on the in-depth investigation carried out, they declared that the dispute was admissible and validated the results of the presidential election offered by the CNE.

He pointed out that the physical/digital materials on the elections were thoroughly and deeply examined, executed in accordance with the highest national and international standards: “Based on the process, the CNE bulletins are supported by the minutes of scrutiny. by the voting machines deployed in the process. The machines coincide with the centers of integration,” said the judge.

It confirmed the competence of the Electoral Chamber of the TSJ to initiate a judicial investigation process, assess the results of the electoral process and resolve the dispute. He declared that the courts of justice are cases to decide in the Rule of Law.

He pointed out that the competition is based on legislation and local legislation compared to other regional and global experiences (he mentioned the Mexican court among them).

He emphasized the help of the CNE when he was elected, except for one prefect who did not do so. He recalled that out of the 38 political parties that participated in the presidential elections, they all attended appearances in front of the Electoral Chamber of the TSJ and that 33 parties submitted electoral materials.

He stated that nine out of the ten candidates mentioned also attended. He also said that the former candidate Edmundo González was not present and that he was declared in contempt that did not comply with the constitutional order. He emphasized that the representatives of the political parties that supported the former candidate of the Democratic Fair Platform (PUD) did not submit electoral material. During the hearing they reported that they had no minutes and that they had no defence.

The judge confirmed that an attempted coup d’état took place along with a large-scale cyber attack in the country.

He urged the CNE to publish the results in the Electoral Journal, in accordance with article 155 of the Organic Law of Electoral Processes. “The CNE will order the publication of the results in the GE within 30 days of the proclamation,” he informed.

He said he urgently sends a copy of the sentence to the Attorney General of the Republic to determine responsibilities for alleged crimes of impersonation of functions, computer crimes, association to commit a crime and inciting disorder, among others.

He thanked the cooperation of the international observers and experts involved in the assessment of the presidential election. He emphasized the support they showed and the high technical level they had.
