Hello, my friend was self-employed but has been employed again for three years. Now he is on sick leave because of burnout, the AOK Bayern refuses sick pay because he was self-employed. Argumentation of the AOK Bayern: He would not have paid into the cash register for two years and was self-employed. As I said, he has been employed again for over three years and the contributions are paid by the employer – as with everyone else. Is there a law to refer to here?
