According to lawyer Nguyen Tien Hung, the more developed society makes the concept of marriage and family more comfortable. The situation of living together as husband and wife without registering marriage is increasingly common.
Pursuant to Clause 7, Article 3 of the 2014 Law on Marriage and Family, it is stated that living together as husband and wife (cohabitation) is the act of a man and woman organizing a common life and considering each other as husband and wife.
This is proven by the fact that they have a common life, have common property, have children together and are recognized by everyone around them as husband and wife.
Article 14 of this Law also stipulates that men and women who are eligible for marriage according to the provisions of this Law and living together as husband and wife without registering marriage do not give rise to rights and obligations between husband and wife.
“In cases where a man and a woman do not have a marital relationship, do not register their marriage, but live together (cohabit) as husband and wife, the law does not prohibit it and will not violate the law. Besides, marriage It’s voluntary, there’s no regulation about living together, you have to register for marriage,” lawyer Nguyen Tien Hung shared.
The lawyer also noted that living together as husband and wife, having children but not registering marriage, affects social ethics.
“Even though the law does not prohibit or the above actions do not violate the law, we do not encourage them because they have a certain impact on social ethics. Children born out of wedlock may suffer many disadvantages and psychological effects,” the lawyer said.
Regarding the media perspective, expert Ngo Huong Giang shared that he was surprised to learn that some artists and celebrities in Vietnam chose to bet on unmarried marriages.
“Marriage registration is not simply the legalization of the husband and wife relationship, but also affirms the responsibility and civil solidarity between two people. Living an open and Westernized lifestyle despite traditional concepts and marriage laws has caused some people to take marriage lightly. From there, people in marriage view marriage as synonymous with cohabitation and cohabitation, reducing the role of responsibility for each other in family and social activities. This is the consequence of a liberalized lifestyle, heavy individualism, and reduced social role from half-marriages,” expert Ngo Huong Giang replied to Tien Phong.

Experts say that cohabiting and living together as husband and wife without registering marriage violates Vietnamese cultural principles of conduct. This makes social management difficult.
On the other hand, implicitly admitting “half-marital” relationships will make minors see it as something they can do, leaving a series of consequences for society such as the increasing situation of single mothers. The increasing age of mothers, the increasing number of children born out of wedlock, as well as the sharp increase in abortion will put pressure on society…
“That is not to mention the consequences of insecurity and order due to living together and cohabiting. Many shocking criminal cases in recent times partly reflect this situation. Many couples in the process of cohabitation have encountered problems. jealous conflicts or conflicts,” the expert said.
