Faced with the growing use of artificial intelligence (AI) in music creation, the Deezer streaming platform is developing tools to detect AI-generated content, including songs using synthetic artist voices. The aim is to distinguish on the platform the original creations, which are protected by copyright, from illegal and fraudulent content. Not easy, because artists have been creating music with computers for more than half a century… So you have to sort out the original digital creations of others. In a recent press release, Jeronimo Folgueira, CEO of Deezer, explained: “There are huge benefits to using generative AI, but we need to make sure it’s done responsibly. » He wants to act quickly, and “not make the same mistakes the social media giants made when fake news started flooding their platforms. »

In terms of law, to be protected, an original work “must bear the imprint of the personality of its author, who can only be a natural person”, says Arnaud Touati, of the firm Hashtag Avocats. Even if the works created by artificial intelligence are fed by pre-existing works, they are generated by software, and therefore cannot be considered as original works. “However, we are waiting for a European regulation that would clearly define AI”, continues Arnaud Touati. Such a regulation will specify the place of AI in creation, reproduction and counterfeiting.

AI thus poses a problem in terms of voice. Besides manipulating information and scamming by mimicking a specific person’s voice, AI poses a threat to performers and voice actors. “They are protected by the intellectual property code. However, AI can be used to synthesize their voices and then reuse them without their intervention., explains Arnaud Touati. Moreover, the voice is an attribute of personality, and therefore of private life. As such, it is considered personal data. In fact, its processing is subject to the general data protection regulations, at least in Europe. For the lawyer, “there is a legal issue on the reuse of a voice without the consent of the person”. And many lawsuits in perspective!
