Washington Supreme Court Grants Emergency Motion to Keep Pac-12 Governance in Balance

In a dramatic turn of events, the Washington Supreme Court has granted the University of Washington’s emergency motion to prevent Washington State and Oregon State from taking sole control of the Pac-12’s governance and assets for the time being. This ruling comes after a Whitman County Superior Court judge had initially ruled in favor of the two schools, who are set to be the only remaining members of the conference after the other 10 schools depart for other conferences in 2024.

The injunction that was set to give the presidents of Oregon State and Washington State sole voting power in the Pac-12 board has now been temporarily stayed, ensuring the input of all 12 current members for the time being. Motions for discretionary review on the matter are set to be fully filed by December 12.

The Supreme Court commissioner stated that maintaining the current balance of power is the “less disruptive temporary posture” while the court considers whether to grant review.

This ruling effectively delays any aggressive action that Oregon State and Washington State may have wanted to take in terms of controlling the future of the Pac-12. It also ensures that all 12 current members will have an equal voice in decisions regarding the distribution and utilization of the conference’s revenue.

The 10 schools departing the Pac-12 issued a statement expressing their relief at the Supreme Court’s decision, emphasizing the importance of equal governance as long as they remain members of the conference.

On the other hand, Oregon State and Washington State expressed disappointment in the ruling and stated that they remain committed to taking aggressive action to protect their universities and safeguard the Pac-12 Conference.
