Since Hamas Attack, Germany Prioritizes Arms Deliveries to Israel

Following the Hamas terror attack, the German government has elevated Israel’s arms requests to the highest priority. Palestinians have attempted to challenge this decision in court, but their efforts have been unsuccessful.
The Higher Administrative Court of Berlin-Brandenburg (OVG) recently rejected a complaint filed by a father and his son seeking to prohibit the German government from supplying weapons to Israel. The court argued that it was impossible to predict with certainty what decisions the Federal Government would make regarding arms deliveries in the future.
The applicants had attempted to utilize provisional legal protection, which provides temporary relief until a final decision is reached. However, the court dismissed this request, aligning itself with the previous ruling of the Berlin Administrative Court in June, which declared three similar applications from Palestinians inadmissible.
The court emphasized that the Federal Government has broad discretion in making decisions related to arms deliveries, and that it is inappropriate to speculate about future actions based on current circumstances.
