The law is expected to be activated in July Georgiadis for the six days workthe application of which will be combined with the Digital Job Card.

In particular, Law 5053/23 provided for the start of the six-day work for the organizations and holdings of continuous operation, which apply a system of five-day weekly work. These workers will be paid extra for the sixth day with 40% of the daily wage and 115% if it is a holiday, while they will be entitled to a day off during the week.

According to the law, the employment of employees, during the additional day, may not exceed eight hours, while overtime and overtime work by the employee is not permitted. The above employers are obliged to register the details of the working time limits of their employees who will be employed on the sixth day in the declaration of organization of working time before the employees take up their duties.

Conditions, terms and wages of the six-day work

In addition to the above, employers of enterprises or holdings, which are not by their nature continuous operation, but may operate on Monday to Saturday for 24 hours with a rotating shift system and in which employees are employed on a five-day week work, in order – in exceptional cases, in which the company presents an unforeseeable particularly increased workload – to make use of the sixth day of the week, they must:

  • To have declared initially and responsibly to PS ERGANI II that they belong to the specific category.
  • To declare, every time they wish to make use of the 6th day, in advance to PS ERGANI II that the company presents a particularly increased workload during a specific period.

In cases where companies or holdings have five-day night shifts (00.00-06.00), their employment on the 6th day during the night shift is not permitted.

In addition to private businesses, workers in OTAs, DOU, PPC, EYDAP and other businesses in the wider sector, related to public service, can be employed on the sixth day.

Tourism

The decision for exceptional six-day work by businesses with five days, was considered by the government and the competent ministry as a necessary measure to deal with the lack of personnel, in conditions of increased production activity, but also in Tourism, which require more specialized hands than ‘ that the other productive sectors.

Until now, the six-day work is done with the employee’s consent and of course within the framework of the law with the appropriate fees and increments to the daily wage. However, according to market factors, the aim of the companies is to restore the five-day work soon.

ERGANI and Work Card

The main problems identified in TOOL II and the corresponding software should be adapted both for the six-day work and for the Work Card are focused on how the exact time of employment can be proven when the employee performs (due to the nature of his profession) external work.

In this context, the digital time sheet can act as a protection for employers from possible unfair penalties and fines in the future. From the 1st of July, it will be possible to submit the digital timetables and reports through ERGANIS II, i.e. until the end of the following month from the one who marked the digital card.

Thus, there will be no need to announce overtime, or any additional employment needs, since many times employers cannot predict that they will be needed.

Any changes or modifications to the final application of the Digital Work Card will be made through new Ministerial Decisions, which are expected in the next period of time. There, the use of the Card will be more clearly coded in a simpler, more functional way, which will cause less inconvenience to businesses and employees.
