A total of 463,614. That is the number of home mortgages that were granted during 2022. In other words, it is the highest level of the last 12 years (Numbers like this have not been seen since 2010). Compared to 2021, the number increased by 10.9%, according to the National Institute of Statistics (INE).

With these data, it can be said that, who else, who less, has a mortgage. And the question they ask is whether their payment can be deducted in the 2022-2023 Income Statement. And the answer is yes, but not for all.

Therefore, there are a series of conditions that should be taken into account. And it is not a trivial question. Because the savings can be significant.

Who can deduct the mortgage?

To answer this question, it is convenient to go back in time. Specifically, as of January 1, 2013. At that time, the Tax agency limited the deduction for the purchase of a primary residence and the tax benefits that it could entail.

In other words, if a home was purchased after that date, the answer is that there is no deduction for this concept. However, it must be taken into account that a mortgage is contracted for many years to come. Going back to the INE data, The average mortgage in Spain in 2022 was 145,510 euros at 24 yearswith a differential rate of 1% over the Euribor, and a review every 12 months.

Therefore, only those who had acquired the home before 2013 may apply the deduction. But, they must also meet another requirement. Which? so what it has to be the habitual residence. Therefore, the apartment on the beach does not enter into this equation, for example, if you already have another home. Neither are those other properties purchased as an investment.

And what is regular residence? Well, that which constitutes the residence of the taxpayer “for a continuous period of at least three years”. This is how the Tax Agency specifies it, which also indicates that it must be “effectively and permanently inhabited by the taxpayer himselfwithin a period of 12 months, counted from the date of acquisition or completion of the works”.

What can be deducted?

If the above requirements are met, the taxpayer can deduct up to 15% of the amount paid for the mortgage in the previous exercise. In this case, in 2022. Half (7.5%) corresponds to the autonomous part and the other half to the state section.

As specified by the Tax Agency, the maximum base of the deductible investment will be 9,040 euros per year. In other words, the savings may be up to 1,356 euros. If the mortgage has two owners, and they carry out the Income statement separately, the deduction would be applied to a maximum of 18,080 euros. In the Basque Country and Navarra it is different.

In the first, there is no deadline to apply the deduction, and it reaches up to 18%. In the second, the deduction is applied if the home was purchased before January 1, 2018. And the deduction is 15% on a maximum base of 7,000 euros.

The Income statement may include registration and agency expenses, the cost of the appraisal, the Tax on Documented Legal Acts, the mortgage opening commission and the registration cancellation expenses.

What are the housing deduction boxes?

Basically, there are two. On the one hand, box 547, which corresponds to the state section of the deduction indicated above. It is the result of adding the amounts of boxes 0699, 0700, 0702 and 0704. On the other hand, box 548, which corresponds to the regional section of the deduction and corresponds to each CCAA. In this case, it is the result of adding the amounts in boxes 0699, 0701, 0703 and 0705.

Besides, the autonomous communities apply certain deductions for what is known as exceptional situations. Thus, for example, in Andalusia, there are deductions for investment in protected habitual residence and for investment in habitual residence by young people. In this case, the box is 582.

The boxes are 871 and 874.

In Asturias, on the other hand, they are for renting a habitual residence, for acquisition or rehabilitation in councils at risk of depopulation, or for acquisition of the habitual residence for taxpayers with disabilities, among other cases. The boxes are 884, 885 and 886.

In the case of the Canaries, the box is 926. And it happens by investment in habitual residence. While in Castilla y León, the boxes are 971 and 978: for rental of habitual residence for young people, for acquisition or rehabilitation by young people in rural areas, for investment in rehabilitation to be later rented in rural areas, or for investment in environmental or adaptation facilities for people with disabilities.

In Extremadura it is for acquisition or rehabilitation of habitual housing for young people and for victims of terrorism (box 1010); in Murcia, among other cases, for lease of habitual residence, for investment in installations of renewable energy resources, or for investment in habitual residence by young people under 35 years of age (box 1052); in La Rioja they also focus on young people, the rural environment, and people with disabilities (boxes 1065, 1068 and 1081); as in the Valencian Community (boxes 1092 and 1093).
