LE FIGARO. – What is the legal value of the text adopted Wednesday at COP28 ?

Marion LEMOINE. – Formally, it is a “COP decision”. It is not a legally binding international treaty, like the 1992 United Nations Framework Convention on Climate Change. (which institutionalized the COPs, Editor’s note) or the 2015 Paris Agreement (which set the objective of limiting warming to 1.5 °C). It nonetheless remains a very important document.

Each COP decision has since clarified the way in which States must respect the articles of the Paris agreement

Marion Lemoine, CNRS researcher

Each COP decision has since clarified the way in which States must respect the articles of the Paris agreement. It is a supplement which provides strategic orientations, details on the procedures, standards and means to be implemented to achieve the objectives already set.

If this text is not legally binding, why so much debate ?
