Although the court dismissed the dismissal of Claudio Crespo, it sent a letter to the Eastern Metropolitan Prosecutor’s Office regarding the preliminary report submitted by the former policeman’s defense.

The Seventh Guarantee Court of Santiago rejected the temporary dismissal of Claudio Crespo, former lieutenant colonel of Carabineroswho is accused of unlawful coercion resulting in very serious injuries against Gustavo Gatica, in the context of the social outbreak.

The request was made by Crespo’s defense, showing a preliminary expert report that would account for alleged falsified records by the commissioner and lawyer of the PDI, Cristián Lizama.

Lawyer Pedro Orthusteguy explained to Radio Cooperativa that “the law clearly establishes that officials who carry out a procedure have to sign it, and in this case this did not happen, and that is why the court ordered the records to be forwarded for criminal investigation.”

“We had the background of only one officer, and therefore, the expert was hired and paid by our client, for the purpose of carrying out the review of a single police officer,” Orthusteguy said, but “During the course of that inspection, he discovered that there were also nine other police officers present.”

Although the court dismissed the dismissal of Claudio Crespo, it sent a letter to the Eastern Metropolitan Prosecutor’s Office regarding the preliminary report submitted by the former policeman’s defense.

Faced with this situation, Beatriz Contreras, a lawyer for the Metropolitan INDH, stated that “we value the court’s decision to reject and, ultimately, allow this oral trial preparation hearing to begin.which – as was pointed out inside – had its first date in October of last year.”

Along these lines, Contreras stressed that “we have perceived the objective pursued by the interposition of the various incidents throughout this process as a delaying purpose.”

Regarding the future of the case against Claudio Crespo, the hearing for the preparation of the oral trial will continue next Monday, where the plaintiffs are asking for a sentence of 12 to 15 years in prison for blinding Gustavo Gatica.
