In the midst of a labor landscape marked by uncertainty and change, Employment Regulation Files (ERE) have gained prominence in recent years, raising concern among workers and companies alike. According to the Ministry of Labor, an ERE is a special procedure aimed at obtaining authorization to suspend or terminate labor relations, guaranteeing the rights of workers.

In simple terms, an ERE allows companies to seek approval from the competent authority to carry out mass layoffs, although it can also be used to temporarily suspend work, reduce working hours or terminate contracts. There is a temporary variant called Temporary Employment Regulation File (ERTE), which during the Covid-19 pandemic was widely used as a measure to avoid mass layoffs, providing companies with flexibility during difficult times.

The ERE are presented as a protection measure for companies, since, as they are collective dismissals, workers receive previously negotiated compensation, generally higher than standard compensation for dismissal. They are classified as ERE for termination (definitive dismissal), ERE for suspension (temporary pause in the employment relationship) and ERE for ETOP (economic, technical, organizational or production) causes, each applicable according to the specific circumstances of the company.

The reasons for requesting an ERE are diverse, covering economic, technical, organizational, productive aspects or force majeure situations such as natural disasters or health crises. In summary, the ERE is presented as a complex tool that, when used appropriately, can offer companies a way to adapt to significant changes in their work environment, while protecting the rights of the workers involved.
