Who will stay with the rescued children in Guaviare? this is the war for their custody

While the four children rescued on Friday of last week in the jungles of Guaviare are recovering at the Military Hospital in Bogotá, the ICBF seeks to determine who will be assigned custody; Thus, what was initially a humanitarian drama has become a soap opera with legal overtones.

It is worth remembering that in the plane crash in which they survived, their mother died, along with two other people, and since then they wandered through an inhospitable jungle for 40 days.

One week after they were hospitalized, spokespersons for the care center indicated that children under 13, 9, 4 and 1 years of age “They remain in the pediatric area and the evolution of each of them is favourable.”

As this happens, the process that seeks to determine who will have custody due to their condition of being motherless orphans is advanced and to the known allegations about a history of alleged sexual abuse and mistreatment by the father. The person in charge of the proceedings in this regard is the Colombian Institute of Family Welfare, which cited the relatives of the “miracle children” and to those interested or involved in the case, to initiate the Administrative Processes for the Restoration of Rights.

In the case of the 1-year-old baby and the 4-year-old boy, his father is included in this process Miller Manuel Ranoque Morales. In the case of the other two minorswhich are stepchildren of this, will run a similar process.

From the moment the rescue occurred, on June 9, a series of versions have been known regarding the way the family lived that have drawn the attention of the authorities. One of these is that Ranoque Morales physically mistreated his sentimental partner and that he would have even tried to abuse the minor under 13 years of age, as expressed by Fátima Valencia, the maternal grandmother.

The process of reestablishment of the minors began from the moment they were rescued by members of the Military and indigenous Forces.Therefore, they are under the guardianship of an ICBF defender.

“She is the one who accompanies the family and they have organized with accompaniment shifts. The defender has made determinations regarding those shifts”, said the director of the ICBF, Astrid Cáceres.

The father of the little ones has complained that they don’t let him see his stepdaughters. Given this, Cáceres stated that this is due to decisions of an administrative nature within the framework of the process of restitution of children’s rights and stressed that “The minors will be in the care of the ICBF while family problems are resolved.”

In a communication, the ICBF explained that “in an articulated work with the Mucutuy Valencia family, the National Organization of the Indigenous Peoples of the Colombian Amazon – (OPIAC) and the Military Hospital, the Colombian Family Welfare Institute (ICBF) provides support to Lesly, Soleiny, Tien y Cristínthe four brothers who were rescued by the Military Forces and various indigenous communities in the Amazon jungle”.

A coordination table with traditional indigenous authorities supports the decision-making of the Family Ombudsman’s Office ethnic group in favor of restoring the rights of girls and boys.

In this process and after placement, The ICBF will listen to the father and the other relatives, who have a period of 5 business days, that is, until June 27, to attend before a family defender and express their intention to have custody, a decision that will be made by the Institute.
