(24 News) Islamabad High Court Judge Justice Mohsin Akhtar Kayani heard the case related to the punishment of 25 years imprisonment with hard labor for the crime of killing a girl for refusing to marry.

In its judgment, the court wrote that in ordinary circumstances, the punishment for murder is death, the death penalty can be commuted to life imprisonment based on certain parameters, and the trial court must provide reasons for not imposing the death penalty.

Justice Mohsin Akhtar in the judgment said that the entire judgment of the trial court failed to justify the imposition of 25 years and the counsel for the appellant and the state counsel could not provide any reasonable grounds for asking for 25 years imprisonment, the trial court was final. 25 years of imprisonment in the paragraph could not justify the punishment of hard labour.

According to the plaintiff, Shahzad followed the girl for 5 months and then sent Rishta. According to the lawyer, the criminal threatened to kill the girl and her father for refusing the marriage, and on November 30, 2020, at nine thirty in the morning, the girl was shot in the head. He was shot and killed.

The court wrote that the trial court sentenced the accused to 25 years of rigorous imprisonment under section 302C, now the question arises whether the trial court could have looked into the matter under section 302C.

The Islamabad High Court said in the judgment that by declaring the sentence null and void, the case is remanded back for re-judgment.
