Online Gambling Prohibition Ordinance

Why has it not been implemented yet? PAMA leader Anbumani Ramadoss has questioned.

In a press release issued by him in this regard, the Tamil Nadu government has informed the Madras High Court that although the Ordinance to ban online gambling in Tamil Nadu was gazetted last month, it has not been implemented till today.

It is a great mystery that the Ordinance enacted with the aim of preventing the degradation of the people of Tamil Nadu has not been implemented till date. Senior advocate Kapil Sibal, who appeared on behalf of the Tamil Nadu government when the cases against the Online Gambling Prohibition Ordinance enacted in Tamil Nadu came up for hearing yesterday before the first session of the Madras High Court, said that even though the Ordinance has been gazetted, it has not yet been implemented.

Because of that, online gambling companies are not considered criminals. The contention of the Tamil Nadu Government is that no action has been taken against them.

The purpose of an Ordinance is so that the prevention of a crime cannot wait until the Legislature meets to enact a law. While the Tamil Nadu Legislative Assembly was expected to meet on 17th of last month, because it could not wait until then to ban online gambling, the Tamil Nadu Cabinet met on September 26 and approved the Online Gambling Prohibition Ordinance.

While the Tamil Nadu government had announced on June 10 that online gambling would be banned, it has taken so long to approve the emergency law. In the interim alone, 6 people committed suicide after losing money in online gambling.

The Ordinance was gazetted on October 3, a week after the Cabinet approved it. It has been 47 days since then. Till date the Ordinance has not been implemented. Meanwhile, in the assembly session held on the 17th of last month, a bill has been brought and passed as an alternative to the emergency law.

If that is the case, the purpose of hastily and hastily promulgated the emergency law is wasted. After the passing of the Online Gambling Ordinance, online gambling did not take place in Tamil Nadu. Advertisements about online gambling and web links to play it were sent as text messages to people’s phones, but if they clicked on them, they failed to take people to online gambling sites.

However, with the government admitting in the High Court that the Prohibition of Online Gambling Ordinance has not yet been implemented, online gambling companies will now start conducting gambling without any restrictions. It is very dangerous.

Even though online gambling has not taken place for the last one and a half months, three people have committed suicide in the last few weeks after losing money online gambling in the past. How many families will be affected if online gambling resumes based on the information disclosed during the High Court hearing? It is scary to think how many suicides will happen.

While the government itself has admitted that online gambling is a huge social evil, it was discussed 3 times in the cabinet meeting and an ordinance was passed a month and a half ago, it is not fair for the Tamil Nadu government to not implement it yet.

The Tamil Nadu Government should implement the Prohibition of Online Gambling Ordinance from today to fulfill the purpose for which it was enacted. Apart from that, I insist that the governor’s assent to the online gambling ban law passed in the Legislative Assembly should be speedily obtained, he said.
