Wind turbines in Morbihan: after a long legal process, the tide is turning in Guern

The fate of the three wind turbines in Guern (Morbihan) is finally sealed. They should never have existed and must be dismantled. At least, if the operator deigns to comply with the latest court decision. After an interminable legal series dating back more than ten years, the Council of State has just rejected yet another appeal by the SNC Parc éolien de Guern on 28 April.

It all started in 2005 when the building permit was filed, attacked by an association and canceled in 2009. Despite everything, the park was built less than 500 m from several dwellings, which is not regulatory. New permit application in 2012, again refused by several administrative courts. Time passes, appeals are linked, the condition of the wind turbines which continue to operate illegally is deteriorating.

“They should have been dismantled in January 2023”

In 2020, the prefecture of Morbihan gives formal notice to the operator to cease its activity. Two years later, a new decree ordered the dismantling under penalty of a daily penalty of 1,000 euros per day. New legal action by the operator who was once again found wrong by the Nantes Administrative Court of Appeal. Not enough to discourage the company which then seized the Council of State. In vain then.

“The wind turbines should have already been dismantled in January 2023, recalls Sébastien Collet, the lawyer for the association against the Guern wind project. If the operator does not comply with the decision, he is liable to criminal penalties”. Failing this, the State can also carry out the demolition. According to Mr. Collet, “residents will only be really relieved when they have disappeared”.

While the end of this fight seems near, another battle begins, led by an association of inhabitants opposed to the construction… of a new wind farm in the town.
