With seventeen appeals in eighteen months, the Borne government trivializes article 49.3

And seventeen for Elisabeth Borne; even if the Prime Minister was not present in the hemicycle – she is traveling in Ireland – her Minister for Relations with Parliament, Franck Riester, held the government accountable to the Assembly for the adoption of the programming law budget 2023-2027. With article 49 paragraph 3 of the Constitution of the Fifth Republic, the government can have a law approved without carrying out a vote of deputies on the text. This is the first time since 1991 that the system has been used without the head of government appearing in person before the deputies.

Since the constitutional revision of 2008the use of article 49.3 is limited to a single text of law per parliamentary session, with the exception of finance bills (PLF) and social security financing bills (PLFSS), for which the government can use it without limit.

In 546 days since her appointment on May 16, 2022, the Prime Minister will have used article 49.3 on average once a month – every thirty-two days exactly. It does not equal the absolute record held by Michel Rocard, who held his government accountable twenty-eight times between 1988 and 1991, at a time when recourse to this constitutional device was not limited. However, over the duration of his presence in Matignon, the Socialist Prime Minister will only have activated it every thirty-nine days on average.
