14-year-old Lyubcho, accused of murdering his mother, could not withstand the drunken woman’s insults and insults (Review)

Systemic domestic violence preceded the fatal scandal, after which 52-year-old Bistra from Plovdiv died. The woman, who suffered from alcohol addiction, died in her house in Komatevo district on Sunday. Arrested for her death was her son Lyubomir Bilarev, 14 years old, with whom they were alone in the house. Her husband, a taxi driver, was at work at the time.

Lyubcho, his mother and his father Krasimir lived in a two-story house in the outskirts of Plovdiv. Bistra worked abroad for many years and sent money to her husband, who built their home. There are mostly new residents on their street. Neighbors describe them as calm people.

However, the situation behind the four walls of the house was different. The woman was an alcoholic and harassed the boy. Before the judge Petko Minev, who was deciding whether to leave the minor Lyubomir behind bars, his father told that

every day Bistra drank at least a bottle of whiskey,

by picking her up in the morning and combining alcohol with anti-depressant pills.

Under the influence of the various substances, she behaved extremely aggressively with her son. She insulted him, humiliated him and mistreated him in various ways. It happened to him and

she even tried to strangle him

She told him that he was trash, that he was not her son, and made cynical remarks about his grandmother. Little Lyubcho endured until the cup overflowed.

The boy is accused of premeditated murder in the context of domestic violence. Since he has been a minor for 3 months, he may be held criminally liable. However, it became clear from the reasons for determining his remand that the facts may not support the qualification of the accusation, but in fact

to be talking about causing death by negligence

after intentional bodily harm. For this article of the Penal Code, the prescribed sentence is much lighter.

Judge Petko Minev pointed out that the case is still at a very early stage and efforts should be made to establish the mechanism of the act. He is not convinced that Lubcho wanted to kill his mother.

Since he is of a slight build and delivered the blows with his bare hands, Lubomir may not have realized that this could lead to death. In this case, however, there is profuse blood loss as a result of broken ribs. If that hadn’t happened, it’s possible his mother would be alive. “The relevant ones

examinations, which are not yet ready, could give a reasoned answer

whether he intended to cause death or whether it occurred subsequently,” said the judge.

According to the judge, there is no danger of Lyubomir committing a new crime, because as soon as they found out that Bistra had died, he and his father filed a report on the 112 telephone number, then gave detailed explanations to the investigators. “The defendant admitted his guilt, explained the mechanism and told about their relationship,” said Petko Minev.

The judge also took into account the good characteristics of the 14-year-old Bilarev. He can bear criminal responsibility for 3 months, he is a student, he has no previous offenses and anti-social behavior. The reason for the accident was his mother’s behavior, which he could not stand.

And since the remand measure “detention in custody” is taken for minors only in extremely specific cases, Minev did not respect the request of the prosecutor’s office and determined “under the supervision of the parent”. The boy will be taken care of by his father.

After the meeting, lawyer Krasimir Bakov described the decision as “absolutely legal and fair”, and prosecutor Anelia Trifonova said that she had not yet decided whether to exercise the right to protest. If he does, the case will be considered next week by the Court of Appeal in Plovdiv.
