In today’s meeting, the government approved the amendments to the “Government Structure and Activities” law and considered it urgent.

In the case of the adoption of the regulation proposed by the project, it will be possible to comprehensively and systematically regulate the procedure of choosing a judge from Armenia in the European Court and the requirements submitted to the candidates by the decision (decisions) of the Prime Minister.

In particular, the Prime Minister will decide to form a committee and confirm its composition. The committee, in accordance with the approved procedure, will organize and conduct the selection process in two stages, evaluate the participants and, finally, the list of the three best participants will be submitted for approval in the prescribed manner.

It should be noted that the first judge of Armenia served at the European Court of Human Rights from 2003 to 2014, and the term of office of the judge who has been serving since 2015 is coming to an end.

Previously, the selection of Armenian judges at the ECtHR was organized by the presidential decree of 2014 “On establishing a competition commission for the selection of candidates nominated by the Republic of Armenia for the position of a judge of the European Court of Human Rights, approving the commission’s activities and the procedure for selecting candidates” and related decisions adopted by the Competition Commission.

Currently, considering the selection process of the three candidates submitted to the PACE for the election of a judge from Armenia, the candidate candidates, the creation of equal conditions for nomination, the imperative to have impartial, transparent and public procedures for their selection, it is necessary to make an amendment to the Law “On the Activity and Structure of the Government” 7- in Article 3., which will be the basis for the adoption of relevant decisions of the Prime Minister, which in turn will be aimed at comprehensively and systematically regulating the procedure for selecting a judge from the Republic of Armenia in the European Court.
