“My creations were displayed everywhere”: she wins her counterfeiting fight against L’Oréal

Because she’s worth it and she hasn’t given up, Pascale Nivet Bernetière has made the giant L’Oréal fold. This Rennaise, creator of the Céleste Mogador brand, succeeded in having Atelier Cologne, a perfume house which belongs to the world number one in cosmetics, convicted for counterfeiting. She had used the artist’s brooches without his authorization in order to promote his products around the world.

“We are fighters, my husband and I,” relishes Pascale. It all started in 2018 when the Rennaise who makes magnificent embroidered brooches as chic as they are fanciful was contacted by Atelier Cologne who promised her a collaboration during informal exchanges, but without any contract being concluded.

“I felt like I had been robbed”

Flattered, she agreed, after exchanges by SMS, to send a few unique pieces in record time, so that they could be integrated into the decor of a shooting organized by Atelier Cologne in New York to promote a single perfume.

Left without news, she discovered much later and by chance that her creations were massively used in promotional materials in stores and on social networks for different products without her ever being mentioned. “I was really angry, I felt like I had been robbed. While I was struggling to run my small business, my creations were being displayed all over the world,” she explains.

After seizure, she summoned Atelier Cologne before the Paris judicial court and won at first instance. In 2021, the company is ordered to pay her and her company the sum of 18,000 euros. “Despite this, they continued to use my pins in their ads,” she adds. Determined not to give in and to obtain better compensation, she appealed and finally obtained 100,000 euros.
