In a number of decisions and conclusions, the Commission for the Protection of Competition addressed the issue of the price reduction of the product in the case of a discount, recording the following.
the average price of the sale of the product or the provision of the service is the average arithmetical price of the sale of the product or the provision of the service during the month preceding the start of the campaign,
if there was no change in the price of the sale of the product or the provision of the service during the month preceding the day of the promotion for the sale of the product or the provision of the service, then there is no need to calculate the “average price”, because the selling price of any day of the previous month is the average price of the product itself,
in case of different sales prices of the product on a specific day, the highest sales price of the product on that day is considered in favor of the campaigner,
in the event that the sale of the given product was not carried out on all days of the month prior to the start of the campaign, then for the day when the sale was not carried out, in favor of the person carrying out the campaign, the sales price is accepted as the highest of the sales prices of the preceding or following days, if there is a price change on those days, including: There is no information available in the Commission regarding price reduction based on the implementation of any campaign,
the recorded sale price is not considered the sale price of the product of the given day, if the campaign operator proves that the application of this price is due to a marketing policy addressed to a separate group of people based on non-discriminatory, objective criteria, and the campaign operator has had a sale of the product during the month prior to the start of the campaign a sale at a high price or at least an offer for sale.
