Samvel Hakobyan, a member of the “Mother Armenia” faction of the Yerevan Council of Elders, wrote:
“The lawsuit challenging the legality of Tigran Avinyan’s assumption of authority is in court
As I have already informed, by the decision of “Mother Armenia” I applied to the court to dispute the legality of Tigran Avinyan’s assumption of the powers of the mayor of Yerevan. There were two lawsuits. One was rejected by the 1st instance court and we challenged that rejection in the Court of Appeals. The other lawsuit was accepted, and the preliminary court session in that administrative case was scheduled for March 5 of this year.
Let me remind you that Tigran Avinyan assumed the powers of the mayor at a special session of the Council of Aldermen, which was not authorized, because the quorum was not secured. At least 33 members of the Council of Elders should have been present at that session, which did not happen.
In the case of the election of the mayor, the CPC made a shady deal, and by securing a quorum, we got a minority government. But all the same, the assumption of powers was in violation of the law. Perhaps, after taking the mayor’s seat, they were probably happy and forgot to make the deal as a package so that there would be a quorum at the special session, but that is their problem.”
