The regulatory challenge targets an authorization granted last month by the Federal Communications Commission, clearing the California space tech company to launch its reflective prototype. While the startup frames the technology as a clean energy solution, scientific and environmental groups argue the regulatory greenlight ignored profound risks to public safety, optical astronomy, and ecological patterns.

Earthjustice Petition Argues FCC Ignored Legal Responsibilities

Filed by the nonprofit environmental law organization Earthjustice on behalf of DarkSky International, Environment America, Public Employees for Environmental Responsibility, and the American Bird Conservancy, the 30-page petition-for-reconsideration claims the regulatory decision was fundamentally flawed.

According to the filing, the agency committed multiple legal and factual errors by clearing the project without properly assessing its terrestrial and orbital consequences. The petition contends that the commission’s reasoning would place light intentionally reflected from outer space entirely outside of federal oversight.

Reflect Orbital was founded in 2021 with the stated aim of making clean energy available on demand. The company’s proposed Earendil-1 satellite carries a deployable mirror measuring 59 feet across in Nbcnews reporting, or 60 by 60 feet according to PCMag, and roughly 18 meters wide in coverage. The spacecraft will operate from an altitude of around 400 miles, or approximately 625 kilometers, designed to focus a beam of light spanning roughly 3 to 3.1 miles across onto the surface of the planet during nighttime hours.

Commercial Ambitions Meet Scientific Backlash

Reflect Orbital envisions a future commercial megaconstellation of more than 50,000 satellites by 2035 to deliver sunlight to ground-based solar farms after sunset, illuminate disaster-struck areas for emergency workers, boost agricultural production, and brighten urban streets. The startup has stated it would charge about $5,000 per hour for the service and claims it would avoid lighting sensitive environments or designated astronomy zones, with the ability to adjust or turn off the beam by rotating the satellite.

However, the proposal has triggered intense pushback from the scientific community. The initial application drew an extremely high 1,800 public comments, reflecting widespread alarm over the prospect of artificial night illumination.

Astronomers warn that even a single test satellite will disrupt research. Dr. Olivier Hainaut of the European Southern Observatory noted that while a single prototype could be studied, a constellation would create a major problem for optical astronomy. Dr. Robert Massey, deputy executive director of the Royal Astronomical Society, added that a constellation could make hundreds of objects as bright as Venus visible across the sky simultaneously, effectively destroying the view of the stars.

Researchers also emphasize that telescopes amplify incoming light, meaning the reflection could easily destroy delicate camera equipment on professional telescopes and pose serious hazards to amateur stargazers.

Safety Experts Warn of Glare and Eye Damage Risks

Beyond astronomy, experts are raising urgent flags regarding human safety on the ground. Because the reflected beam will sweep across populated regions without advance warning to individuals underneath it, optical and LED lighting engineer Eric Bretschneider compared the concentration of sunlight to a helicopter shining an intense spotlight directly at motorists, pilots, and pedestrians.

Bretschneider warned that people might instinctively look toward an unfamiliar bright light in the dark sky, risking severe retinal damage and permanent vision loss. Dr. Travis Longcore, co-chair of UCLA’s Environmental Science and Engineering Program, went further, characterizing the commercial space mirror project as an existential threat to optical astronomy and warning of the catastrophic disruption of daily and seasonal light-and-dark patterns governing Earth’s ecosystems.

Technical Skepticism Over Power Generation and Utility

Independent calculations by scientists have also challenged the core economic and technical premise of the company’s business model. Dr. John Barentine, co-founder and president of the Center for Space Environmentalism, calculated that a single satellite would deliver an irradiance of roughly 0.004 watts per square meter at Earth’s surface—far short of the approximately 200 watts per square meter required to generate useful commercial electricity for solar farms.

The regulator also emphasized that the project could advance American leadership in space, while dismissing public comments focused on the hypothetical future deployment of tens of thousands of spacecraft.

Reflect Orbital did not immediately respond to requests for comment regarding the newly filed petition, but the startup continues preparations to launch the Earendil-1 demonstration mission later this year.
