Kroy “KJ” Biermann Jr., the 15-year-old son of former Real Housewives of Atlanta stars Kim Zolciak and Kroy Biermann, was arrested on August 17, 2026, in Alpharetta, Georgia, on charges of aggravated sodomy and aggravated sexual battery following an alleged April 23 incident at a gym changing area.
The Arrest and Court Records at Life Time Fitness
According to Fulton County Georgia Juvenile court papers, the arrest stems from an encounter on April 23, 2026, inside a family locker room and co-ed sauna area at a Life Time fitness facility in Alpharetta. The alleged victim, a 15-year-old female classmate who described herself as the best friend of KJ’s girlfriend, told investigators that the teenager led her into the changing space by saying hey look at this
before initiating physical contact.

The documents state that the girl repeatedly told the suspect no
as he attempted to pull down her pants for sexual intercourse, forced oral sex, and digitally penetrated her vagina. Investigators noted that KJ did not scan into the gym on the day of the alleged assault, though security camera footage captured him on the premises. After managing to escape, the teenager left the building, experienced a panic attack at a nearby Starbucks, and contacted her family.
Police officers were dispatched to TMZ on April 24, 2026, where the alleged victim underwent a sexual assault examination. Hospital documentation cited in the police report indicated that doctors found no evidence of male DNA in her mouth or vagina.
Custody Status and Legal Proceedings
Following the police investigation—which included an officer speaking with Kroy Biermann Sr. on May 18 after initial contact attempts began May 14—authorities took the 15-year-old into custody on Monday, August 17. KJ is currently being held without bond at the Metro Regional Youth Detention Center. A preliminary court hearing is scheduled for September 1, 2026.

The arrest compounds a turbulent period for the family. Kim Zolciak and Kroy Biermann married in 2011—the year KJ was born—and later welcomed son Kash and twins Kaia and Kane. Biermann also adopted Zolciak’s two eldest daughters, Ariana and Brielle. After more than a decade of marriage, the couple filed for divorce in 2023, initiating ongoing legal proceedings marked by bitter custody disputes and temporary custody orders.
Family Response and Defense Statements
In response to the charges, Kim Zolciak issued a vehement defense of her son through an exclusive statement, condemning the allegations as entirely unfounded and highlighting test results obtained by the defense.
“The allegations being made against my son are nothing short of reckless and deeply troubling. He categorically denies ever being involved with this woman or engaging in the conduct she has alleged. My son voluntarily took a polygraph examination regarding these allegations and passed. Additionally, an examination was conducted, and no DNA belonging to my son was found. We are also aware that this individual has made similar allegations involving two other people, which raises serious concerns that deserve to be carefully examined.”
