Global soccer body FIFA has accused UEFA of launching a smear campaign after European football leadership filed U.S. legal requests to force document disclosures regarding a failed World Cup investor plan involving prospective lead investor Joshua Kushner.
The bitter feud between international football’s governing bodies intensified this week as FIFA filed a motion to intervene in New York, pushing back against aggressive legal maneuvers by the Union of European Football Associations. At the heart of the clash sits the now-abandoned FIFA Forward Enterprise (FFE) proposal, a divisive initiative unveiled in July that sought to sell a 20 per cent stake in FIFA’s commercial and event operations for $4.2billion (£3.1bn).
That high-stakes financial plan triggered an immediate uproar across the sport. Confronted with a fierce backlash that included threats from UEFA to boycott the World Cup, FIFA quickly aborted the proposal in response to the friction. Yet the political fallout has only escalated, leaving the leadership of FIFA President Gianni Infantino under intense siege from multiple regional confederations.
Legal Crossfire and the U.S. Court Filings
Rather than letting the abandoned deal rest, UEFA filed disclosure requests in the U.S. on August 28. The European governing body aimed to secure internal documents from FIFA, JPMorgan, Bann Ventures, and Thrive Eternal—the U.S. investment fund run by Joshua Kushner—to prepare for potential criminal proceedings in Switzerland against Infantino for alleged criminal mismanagement.
UEFA’s legal representation argued that the $4.2bn valuation was absurdly low
and failed to reflect an open, competitive auction, accusing Infantino of promoting a fraudulently off-market price for personal benefit. In response, FIFA struck back hard in its New York court filing, dismissing the foreign legal actions as empty posturing designed to inflict maximum political damage.
FIFA’s lawyers argued that UEFA lacks the legal standing to demand internal files because no criminal proceedings actually exist in Switzerland, and UEFA has suffered no financial loss. Furthermore, FIFA accused European organizers of trying to bypass Swiss courts by heading straight to U.S. judges on a fishing expedition that would expose sensitive and proprietary information.
Economic Motives and Global Confederacy Divisions
The governance battle exposes a deep economic fracture between European soccer powerhouses and developing football nations. FIFA claimed in its court documents that UEFA’s fierce opposition to the FFE plan stemmed from a desire to protect its own financial dominance by preventing smaller nations from having the financial strength to compete with the European elite.
By raising funds to develop soccer globally, FIFA argued, the project would empower developing regions so more players could represent their home countries and play in their home leagues rather than playing abroad.
At the same time, Infantino faces pressure beyond Europe. North and Central America’s CONCACAF and the Asian Football Confederation joined forces with UEFA, issuing a blunt joint letter criticizing the incumbent president’s grip on power ahead of an upcoming election cycle where Infantino had hoped to be re-elected unopposed for a fourth and final term next March.
CONCACAF and confederation leaders stated via Yahoo Sports that leadership in football is not a possession.
Investor Regrets and What Comes Next
The fallout has also claimed casualties among corporate partners. Speaking publicly for the first time since the plan collapsed, Joshua Kushner released a statement acknowledging that his firm failed to appreciate the political dynamics of global football, noting that Thrive would never have gotten involved in the plan had they known what it would devolve into.
With FIFA asking U.S. judges to defer document access or toss the applications out entirely, the immediate legal battlefield centers on whether American courts will permit the discovery requests to move forward. The outcome will determine if UEFA can successfully translate its pressure campaign into formal criminal investigations in Switzerland.
