The Supreme Court heard the case filed by O. Panneerselvam against this order and ordered the single judge to hear the case related to the AIADMK General Committee itself and to complete the case within 2 weeks.
In this situation, Justice Krishnan Ramasamy, in the order issued on July 11, had made unnecessary comments about O. Panneerselvam, who was not involved in the case, and therefore a letter was sent to Chief Justice Muneeshwar Nath Bhandari on behalf of O. Panneerselvam and Vairamuthu to transfer the case related to the General Assembly to another judge.
However, when these cases came up for hearing today before Judge Krishnan Ramasamy, Vairamuthu’s side requested that the hearing be postponed to tomorrow. When the judge adjourned the cases to tomorrow afternoon, O. Panneerselvam’s side requested to adjourn the case to next Monday.
Then the judge questioned why. At that time, it was reported that since the OPS side had expressed strong views against them in the order issued on 11th July and the order was issued at the last time when the General Assembly was to be held, they have submitted a request to the Chief Justice requesting the transfer of these cases to another judge.
Dissatisfied with the OPS’s explanation, Justice Krishnan Ramasamy strongly condemned the complaint to the Chief Justice that the judge should be transferred. The judge who registered his displeasure as this action is not only an act of defamation of the judiciary but also a disgraceful act, said that if there is a mistake in the verdict, the High Court is likely to appeal to the Supreme Court and if there is an amendment, he may have appealed to him.
The judge expressed his displeasure that the petitioner (OPS) is now acting in his defense to justify his views expressed in his order.
After that, the judge said that he would take care of the process of the request to change the judge separately. OPS also told the lawyer that you should not mislead your petitioner and that you can file contempt of court cases in cases where you have no faith in the judge.
Later, the judge rejected the OPS side’s request to adjourn the case hearing to Monday and postponed the hearing of the case saying that he will hear the cases related to the AIADMK General Committee tomorrow afternoon based on the request of another petitioner, Vairamuthu.
Subsequently, counsel NGR on behalf of OPS asked the Chief Justice about the comments made by Justice Krishnan Ramasamy this afternoon. Prasad appealed. In that, the judge has said that he will hear the case tomorrow as he has given them a letter asking them to change the judge. Even this afternoon he has criticized my actions as low quality. The request to change the judge should be considered.” as requested. Chief Justice Munishwar Nath Bhandari has explained that he will see the letter.
