“Congress has taken the unprecedented step of intentionally isolating and banning TikTok: an active online forum for protected speech and expression used by 170 million Americans to create, share, and view videos over the Internet,” TikTok said in its petition. filed with the Court of Appeals for the District of Columbia.
In the petition, TikTok added that for the first time in history, the US Congress passed a law targeting one specific platform with a permanent, nationwide ban.
Additionally, it prohibits all Americans from participating in the unique online community that has more than 1 billion users worldwide.
TikTok said the Act to Protect Americans from Apps Controlled by Foreign Competitors is unconstitutional.
“The ban on TikTok is clearly unconstitutional, even the supporters of the law recognize that fact, and therefore try their best to portray the law as not a ban at all, but simply a regulation of ownership of TikTok,” TikTok continued.
