In the text of the injunction, the substitute judge Diana Wanderlei accepts the Bolsonarist claim that Viana does not have fluency in English at an advanced level, and that this ability would be one of the requirements to hold the position.

“When it comes to ApexBrasil, the institution’s primary objective, as seen, is to promote the implementation of export promotion policies, which, obviously, happens in the context of international relations. And in this business environment, it becomes of fundamental importance for the executive structure to know the mother tongue of international business affairs”, wrote the magistrate.

In turn, the AGU stated in a statement that “the plaintiff [Flávio Bolsonaro] it did not meet the essential procedural requirements, nor did it prove the actual damage caused by the act of appointment”.

“The AGU will demonstrate to TRF1 the need to declare the claims made in the popular action unfounded and determine the immediate return of Viana to the presidency of ApexBrasil”, completed the statement.
