Apple has asked the US Court of Appeal to overturn the ban on the supply and sale of the brand’s smartwatches. This was reported by Reuters with reference to the corporation’s statement, Day.Az reports with reference to Lenta.ru.
Apple’s lawyers said the US government’s decision to ban Apple Watch sales in the country was based on “a series of fundamentally flawed patent decisions.” The company was banned from supplying Apple Watch 9 and Apple Watch Ultra 2 to the country due to patent violation.
The corporation said that Masimo, which owns the patent, will still have to prove its position in court. The company’s experts also noted that Masimo indicates that Apple allegedly stole the idea of a device that determines the level of oxygen saturation in the blood. The corporation is confident that such a gadget does not exist and the plaintiff allegedly will not be able to create it.
Reuters journalists contacted Apple and Masimo for comment but did not receive a prompt response.
American sales of the new Apple Watch smartwatch were banned in December. The reason for the ban was a patent related to technology for detecting blood oxygen saturation levels, which Apple could violate.
