Apple notes that Masimo filed the lawsuit in 2021, when the company itself did not yet have a finished product of the same class, and as evidence of violations by Apple, the company provided the court with CAD drawings of its future smartwatches, which were eventually released only in 2022 year. Thus, Apple is trying to prove to the court that at the time of filing the claim, the plaintiff had no grounds for this.

The company also expresses concerns that if the court ultimately sides with Masimo, it will set a precedent for other companies that do not have any actual products but that have creativity and CAD software.
