The US Federal Court of Appeal suspended the previously imposed ban on the import and sale in the US of certain models of Apple smart watches, namely the Series 9 and Ultra 2. Sales resumed yesterday, December 27, in Apple branded stores, and today, December 28, these watches will appear and in online sales, reports Reuters.
The ban on the sale of these models, introduced by the US International Trade Commission (ITC), came into force on December 26. The reason for the ban on the import and sale of these models was a court decision that in January ruled that Apple had violated a patent from medical technology developer Masimo. Apple Watch Series 9 and Watch Ultra 2 use a blood oxygen sensor that Masimo calls its patented design.
On December 26, Apple filed an appeal against the import and sales ban and asked the court to delay the start of the ban while it considers its appeal. In addition, the company presented variants of the two specified watch models, modified to take into account the court’s claims. It is expected that the relevant departments will study these options and make a decision on the possibility of importing and selling them on January 12. The federal appeals court said it would consider Apple’s application to extend the ban’s overturn throughout the appeal process and announce its decision as early as January 15.
