A British journalist and political commentator, Sami Hamdi, is returning to the United Kingdom after spending approximately two weeks in U.S. Immigration and Customs Enforcement (ICE) custody. His detention has sparked concerns about the targeting of journalists critical of Israeli government policies and the suppression of speech regarding the ongoing conflict in Gaza.
Hamdi was detained at San Francisco International Airport on Oct. 26 while on a speaking tour in the United States. He agreed to voluntarily leave the country on Monday, according to the California chapter of the Council on American-Islamic Relations (CAIR-CA), one of the organizations representing him.
“I am profoundly grateful to my family, my legal team and every individual in the global community who prayed, protested and refused to be silent,” Hamdi stated Wednesday evening. “Let the record show: I broke no law and posed no threat. My only ‘offense’ was speaking the unvarnished truth about the genocide in Gaza.”
Hamdi emphasized that his departure is not an admission of wrongdoing. “I am departing now, voluntarily, to reunite with my loved ones, not because the U.S. government ever established a credible case against me,” he said. He characterized his detention as a demonstration of how “a Muslim journalist can be held captive because extremists, amplified on social media, seek to weaponize state policy against inconvenient speech.” He further asserted that this situation represents “a searing indictment of any nation that claims to uphold free speech, a free press and the right to due process.”
Accusations and Visa Revocation
At the time of his detainment, a federal spokesperson accused Hamdi, without providing evidence, of “support(ing) terrorism and undermin(ing) American national security.” The U.S. Department of Homeland Security subsequently revoked his visitor visa.
CAIR-CA maintains that no criminal charges were filed against Hamdi and that the government’s case rested on “a baseless overstay claim.” Hussam Ayloush, CEO of CAIR-CA, stated, “Let’s be absolutely clear: if the government had any evidence to back up the smears it has been tweeting about Sami, he would not be on a flight home right now.” Ayloush added, “They locked a journalist in an ICE cell and tried to frighten the public with baseless claims, and, in the end, all they proved was their own abuse of power. That should alarm anyone who cares about the rule of law.”
Harsh Conditions in ICE Custody
According to CAIR-CA, Hamdi endured difficult conditions while in ICE custody. The organization alleges he was confined in a crowded room with dozens of other detainees, experienced an eight-hour delay in receiving medical attention while suffering from “excruciating pain,” and was subjected to multiple, unannounced transfers while fully shackled.
Pattern of Targeting
CAIR-CA asserts that Hamdi’s case is not isolated, but rather part of a broader pattern of authorities targeting journalists and advocates who voice support for Palestinian human rights and critique Israeli government policies. The organization stated it will continue to advocate for transparency and accountability regarding the government’s treatment of Hamdi and others facing similar circumstances.
Hamdi was represented in legal proceedings by attorney Hassan M. Ahmad of the HMA Law Firm and the Muslim Legal Fund. Under the terms of his departure agreement, he will not be considered a danger to the community or to national security.
This case raises critical questions about the balance between national security concerns and the protection of free speech, particularly for those expressing views on sensitive geopolitical issues.
