Can people with hearing impairment retire due to disability?

People with hearing impairments have a specific type of retirement, called “Special Retirement for Persons with Disabilities”.

This form of retirement, guaranteed by Complementary Law No. 142 of 2013, stands out because it does not qualify as disability retirement.

Contrary to common misconceptions, deafness does not imply incapacity for work. Hearing impairment ranges from partial to total hearing impairments, and can be congenital or acquired throughout life, often related to diseases.

Classified according to the ability to detect decibels, hearing impairments are subdivided into mild, moderate, severe and profound. The latter may require the use of hearing aids, prosthetics, sign language, and even lip reading techniques.

How does retirement work?

Due to the difficulties in communication and social interaction faced by hearing impaired people, Complementary Law 142/2013 recognizes the right to special retirement for all taxpayers with some form of disability.

There are two types of Retirement for Persons with Disabilities:

Age Retirement:Men at age 60, women at age 55; Minimum of 15 years of contribution; Proof of disability during the contribution period.Retirement value: 70% of the Benefit Salary + 1% per year worked.Retirement by time of contribution:Minimum time varies depending on the degree of disability and the gender of the insured.Retirement value: Average of the 80% highest salaries received since July/1994.

How to grant retirement?

The assessment and granting of retirement takes place through INSS expertise. Disability is classified according to Complementary Law No. 142/2013, using the Brazilian Functionality Index Applied for Retirement Purposes (IFBrA).

Severe Disability: Score up to 5,739.Moderate Disability: Score between 5,740 and 6,354.Mild Disability: Score between 6,355 and 7,584.

How to schedule?

Scheduling can be done via Meu INSS, mobile app or online:

Access My INSS and click on “What do you need?” and write “Schedule Expertise”. Then choose between “Initial Expertise” or “Extension Expertise”. Follow the instructions on the screen. Enter the necessary data to complete the request.

Scheduling can also be done by calling the INSS Call Center at 135.

Necessary documents

Gather essential documents, such as:

Identification document with photo; Work card; Proof of address; ASO issued by the occupational doctor; Letter from the company declaring the last day of work; Medical certificate with diagnosis and treatments; Exams that prove the illness or injury; Prescriptions that indicate the medication used.
