However, the WRC rejected this argument, stating, “The worker was dismissed by WhatsApp message without any meeting nor any fact-finding process.”

The WRC’s ruling emphasized the employer’s failure to consider alternative arrangements or provide the chef with an opportunity to clarify her employment status. “The employer jumped the gun,” the commission stated. “The decision taken on the same day as the employer’s WhatsApp message to contact Revenue amounted, for all intents and purposes, to a summary dismissal, conducted with no regard for fair procedures.”
The commission further noted that even in cases involving immigration concerns, best practices dictate that employers should pause and verify the situation before taking action – a step that was not taken in this instance.
