The Federal Court of Cassation ratified the dismissal of the president of the AFA, Claudio “Chiqui” Tapia, in a case in which a businessman sued him for the alleged violation of a rights contract for matches of the Argentine soccer team.
The highest criminal court declared “inadmissible” an appeal presented by Guillermo Tofoni, owner of the company World Eleven, who denounced the violation of an agreement that assigned him the responsibility of managing the friendly matches of the three-time world champion team.
Judges Ángela Ledesma, Guillermo Yacobucci and Alejandro Slokar considered that the appeal – for the Cassation to intervene to review the dismissal – only exhibits a discrepant position that does not merit the intervention of that instance. “The existence of a federal issue that would enable the intervention of this House as an intermediate court has not been adequately argued,” the resolution maintains.
Tapia had been dismissed in the first instance by Judge Julián Ercolini and that decision was confirmed by Chamber I of the Federal Chamber, with the signature of Pablo Bertuzzi and Leopoldo Bruglia. Tofoni, along with the criminal case, also filed a claim in the Commercial jurisdiction also for the alleged breach of contract.
