Contradictory Clauses in 22nd Amendment – Statement of High Court’s Position (Live)

Although the 22nd Constitutional Amendment Act is constitutional, the High Court has informed the Parliament that a special majority and popular referendum are necessary to pass certain clauses.

During today’s session of Parliament, Speaker Mahinda Yappa Abeywardena announced this position of the High Court.

The High Court declared that some clauses contained in the 22nd Constitution are unconstitutional. Speaker Mahinda Yappa Abeywardana said that the High Court has declared in its interpretation that a simple majority or plebiscite is required to implement them.

Many parties had filed a petition in the court challenging the 22nd Amendment Bill of the Constitution which has been presented in the Parliament.

The petitions were taken up for hearing before a three-judge bench comprising Chief Justice Jayantha Jayasuriya, Bhubaneka Aluvihare and Arjuna Obeysekara.

In this situation, the panel of judges, who completed the hearing of the petitions, announced on August 23 that they would submit their decisions to the Speaker.

Accordingly, Speaker Mahinda Yappa Abeywardena submitted this resolution to the Parliament after the parliamentary session began this morning.
