Through External Circular 20231010000407 of July 31, 2023, the Deputy Minister of Transportation and the Superintendent of Transportation gave scope to External Circular 20231010000327 issued by said authorities on July 10 of this same year.

Below, we highlight the most important considerations of this new circular:

Neither the Vice Ministry of Transportation nor the Superintendence of Transportation are legitimate authorities to define the beginning of validity of Law 2283 of 2023, through which the obligation was created for Automotive Diagnostic Centers to contract “mandatory individual liability insurance.” civil for private service vehicles, which covers material damage caused to third parties”, which is an exclusive power of the legislator. Therefore, the aforementioned law is in force from the moment of its promulgation, that is, on January 5, 2023, in accordance with the provisions of article 9 of said regulation. In accordance with what is indicated in the external circular issued on July 10, 2023, the Superintendency of Transportation had to begin, on August 1, the inspection, surveillance and control tasks regarding compliance with the obligation contained in article 6 of Law 2283. However, due to the multiple difficulties that union organizations expressed related to contracting insurance, the Superintendent of Transportation indicated that, on September 1, 2023, he would begin the review of compliance with the obligation to contract insurance. .
