The Plenary Session of the Supreme Court of Justice of the Nation (SCJN) will be in charge of determining whether the investigation against former Minister Arturo Zaldívar proceeds.
The Federal Judiciary Council (CJF) confirmed that on April 9, it accepted for processing an anonymous complaint, which did not contain evidence, against the former president of the Court and now a member of Claudia Sheinbaum’s campaign team.
The Supreme Court explains that “in accordance with the regulations that govern the actions of the CJF, it is the responsibility of the President to rule on the admissibility of complaints related to the administrative responsibilities of public servants,” that is, Minister Norma Piña ordered to process the Anonymous complaint.
“It is anticipated that if the complaints indicate the circumstances of time, manner and place that allow for signs of conduct that probably constitute administrative responsibility, investigations may be ordered; that is, even if the complaint or complaint is not accompanied by evidence,” indicated the Judiciary.
In the anonymous complaint, “circumstantial indications of manner, time and place must be noted; the corresponding investigation must be ordered. Under this last assumption, since 2018, investigations have been initiated based on 362 anonymous complaints.”
Under these regulations, President Norma Piña ordered the complaint to be processed; However, since a former minister was involved, “it was considered that the CJF does not have the authority to investigate and, where appropriate, punish the acts attributed to a former minister.”
Therefore, the Administrative Responsibilities Unit of the CJF officially notified the Supreme Court and “for secretarial reasons, on April 10, the General Secretariat of Agreements of the SCJN incorporated the complaint in question to others that have been presented in different cases. The Plenary Session of the Supreme Court will resolve what is appropriate.”
In turn, the Judiciary reported that “by agreement of the President of the CJF (Norma Piña) an ex officio investigation has been initiated due to the leak of a file that contained the proposed Agreement signed electronically by the Head of the General Unit of Investigation of Administrative Responsibilities of the CJF”.
Former Minister Zaldívar accused the violation of his presumption of innocence due to the leak of said agreement in which the anonymous complaint against him was processed.
Likewise, the PAN reported that they will join the request for an impeachment trial for alleged illicit use of functions when he presided over the Court.
Senator Kenia López Rababán assured that Lelo de Larrea must be sanctioned because, according to him, he put the interests of the Presidency above those of the people of Mexico.
Morena supports Zaldívar
For his part, Ricardo Monreal expressed his support for Zaldívar “I think the minister has gone too far, I think she decided to enter the electoral process (…) if she has evidence that verifies and proves the minister’s illegal conduct, she should make it known to the Ministry.” Public”.
