Diddy Appeals 50-Month Sentence, claims Judge overstepped in Prostitution Case
A legal team representing Sean “Diddy” Combs filed an appeal on Tuesday, December 23, demanding his conviction be overturned and seeking his immediate release from prison. The appeal centers on claims that the sentencing judge improperly considered evidence related to charges on which Combs was acquitted, effectively acting as a “thirteenth juror.”
Combs is currently serving a 50-month prison sentence after being convicted this summer on two counts of violating the Mann Act, which prohibits the interstate transportation of individuals for immoral purposes – specifically, prostitution. Despite these convictions, he was acquitted on more serious charges of racketeering conspiracy and sex trafficking by force, fraud, or coercion.
According to the filing, District Judge Arun Subramanian erred during sentencing by suggesting he could consider Combs’ behavior related to the dismissed violent charges. “The judge defied the jury’s verdict and found Combs ‘coerced,’ ‘exploited,’ and ‘forced’ his girlfriends to have sex and led a criminal conspiracy,” a statement within the filing reads, as reported by Page Six. The legal team argues this judicial overreach resulted in the harshest sentence ever imposed for a similar offense, particularly when compared to cases involving the exploitation of vulnerable populations.
The defense contends that much of the evidence presented by the government during the trial “would have been irrelevant and inadmissible” had Combs only been charged with the two interstate prostitution counts that led to his conviction. “Yet the district court – determined to punish Combs for the acquitted counts – considered all that evidence anyway. It did not even follow its own proposed test,” the documents state.
This, the legal team asserts, represents a violation of Combs’ constitutional rights, and they are requesting “immediate release and either grant a judgment of acquittal or vacate and remand for resentencing.”
Federal prosecutors now have until February 20 to submit their response to the appeal, with Combs’ legal team then having until March 13 to file a reply. However, overturning a district court ruling is a notable challenge, as the 2nd Circuit Court of Appeals “rarely overturns district court rulings.” The outcome of this appeal will determine whether Combs will complete his 50-month sentence or be granted a new trial or resentencing.
Why did this happen? Sean “Diddy” Combs was indicted on federal charges including racketeering, sex trafficking, and violating the Mann act. The prosecution alleged a pattern of coercing women into sexual acts and transporting them across state lines for prostitution.
Who is involved? The key figures are Sean “Diddy” Combs, the defendant; District Judge Arun Subramanian, who presided over the trial and sentencing; and Combs’ legal team, who are filing the appeal. Federal prosecutors are also involved, tasked with responding to the appeal.
What was the outcome of the trial? combs was acquitted of the more serious charges of racketeering and sex trafficking, but convicted on two counts of violating the Mann Act.He was sentenced to 50 months in prison.
How did it end (so far)? Combs’ legal team has filed an appeal arguing the judge improperly considered evidence from the acquitted charges during sentencing, leading to an excessively harsh penalty. The case is now before the 2nd Circuit Court of Appeals, which will hear arguments from both sides before making a decision. The appeal was filed on December 23, 2023, and the process is ongoing.
