The decree of dissolution of the Earth Uprisings is suspended. According to the Council of State, which rendered its decision this Friday, August 11, the government has not provided proof that the environmental collective endorses “violent acts against people”.
“The judges in summary proceedings consider that there is a serious doubt as to the qualification of provocation to violent acts against persons and property retained by the decree of dissolution”, indicates the high administrative court, which has yet to decide. decide on the merits of the case, which “should be able to intervene quickly, probably in the fall”.
“Victory”, quickly reacted the movement on Twitter (renamed “X”). “It’s a snub for the government but the decision speaks for itself,” later reacted one of the “voices of the movement”, Basile Dutertre to AFP. “The decision of the Council of State is extremely clear, it calls for almost no comment (…), if it is confirmed it will constitute important case law on the right to disobedience in France”, estimated Basile Dutertre.
The Ministry of the Interior has “taken note” of this decision, stressing that it “does not prejudge the decision that the Council of State will take on the merits”
The case had been debated during a river hearing of nearly three hours on Tuesday. At the hearing, the lawyers of the collective, Me Antoine Lyon-Caen and Aïnoha Pascual, had castigated the many “approximations” and “untruths” put forward according to them by the government.

The government, which has been engaged in a standoff with the collective for several months, accuses the Uprisings of the Earth of “calling” for violence and “participating” in it, which the latter strongly contest.
Interior Minister Gérald Darmanin announced at the end of March that he had initiated the procedure for dissolving the movement, which he held responsible for violent clashes in Sainte-Soline during a prohibited demonstration against the water reservoirs.
The Earth Uprisings were born in January 2021 in the former ZAD (zone to defend) of Notre-Dame-des-Landes (Loire-Atlantique) to “fight against artificialization and against agro-industrial grabbing” , recently detailed for AFP Benoît Feuillu (a pseudonym), one of the spokespersons for the movement.
