This is a key moment for Eric Dupond-Moretti. At the start of summer, the Minister of Justice is everywhere. Both on the media front, on the subject of urban violence, and on the political front in the National Assembly, where the two bills he is carrying are discussed – orientation and programming of justice, as well as the organic text on the status of the judiciary. And Friday, July 7, it will be on the judicial front, since his appeals against his referral to the Court of Justice of the Republic (CJR, the only court authorized to judge ministers in office) will be examined by the Court of Cassation. In the space of a few days, many things will have happened for the former criminal lawyer.
Since the start of the riots following the death in Nanterre of Nahel M., 17, killed by a policeman, Mr. Dupond-Moretti has spared no effort. He appeared, alongside Gérald Darmanin, the Minister of the Interior, and Elisabeth Borne, the Prime Minister, as one of the most active in the government. In the aftermath of the first urban violence, he went to the field to provide support to the personnel targeted, to visit the justice premises attacked.
Friday, June 30, he published a circular requesting a criminal response “firm, fast and systematic” against the perpetrators of degradation and/or aggression. It also targeted parents of minors by calling for the use of the provision allowing them to engage their criminal liability. He insisted on this point again in another circular dated July 5, which also asks for a particular “firmness” for minors, favoring referral in cases of harm to persons, elected officials or serious harm to public property. It also invites prosecutors to check whether, for minors under 13 repeating, it is possible, under certain conditions, to reverse “the presumption of non-discernment” and yes “prosecutions can be initiated” or pronounced alternative measures.

In summary, Eric Dupond-Moretti has decided to take on the costume of the repressive Minister of Justice, a sort of complement – and not a counterweight – to the Ministry of the Interior. At the Chancellery, this analysis is rejected: “There is a strong desire to restore republican order on the part of the Ministry of Justice and the Ministry of the Interior. This requires adequate criminal justice in terms of sentencing and mobilization. »
