The defense team of the 2nd Vaza Jato hacker, Thiago Eliezer, submitted a request to the Minister of the Federal Supreme Court, Alexandre de Moraes, for the searches and seizures carried out on August 2 against the client to be annulled, in addition to the end of the breach of bank secrecy.
Eliezer is being investigated in the inquiry into the invasions of the National Council of Justice system, and was the target of the 3FA operation, which was responsible for the arrest of Walter Delgatti and for the execution of warrants against deputy Carla Zambelli.
According to Eliezer’s lawyers, so far there is no evidence to justify the measures, and that “the only adequate way to collect evidence of the commission of the crime being investigated”.
To the Federal Police, one of those investigated, Walter Delgatti, said in a statement that Eliezer had the passwords of the systems that had been invaded. According to Delgatti, the 10 release permits that were included in the CNH platform would have been made by the hacker.
Eliezer was arrested in July 2019, being one of the targets of Operation Spoofing, but left prison in September 2020 using an electronic anklet.
The hacker’s lawyers say the searches were motivated only by Delgatti’s testimony. The PF has maintained the searches since the beginning of this month (August).
In the petition sent by the lawyers, they emphasize: “The Federal Police could not have represented the search and seizure against third parties, based exclusively on Walter’s report, since, as seen, no further steps were taken to attest to the veracity of the information presented by Delgatti”.
