Lhe Prime Minister Head of the Government of the transition took part in the opening of the orientation debates on the new Constitution, an initiative of the National Council of the CNT Transition. In his speech given to the honorable national advisers, Dr. Bernard Goumou, this approach fits perfectly with the vision of the President, Colonel Mamadi DOUMBOUYA, who, during his investiture, affirmed according to him “We will have to work together to lay the foundations for a reconciled society and committed to its socio-economic development…”. This is why he expects the new Constitution to be a text which must get rid of all considerations of whatever nature so that it (text) can resist temptations. Extract !

“A chronogram of the transition has been drawn up in ten (10) points for the return to constitutional order at the end of the twenty-four (24) months of the transitional period. This timetable was the subject of an agreement with the Economic Community of West African States (ECOWAS) endorsed by the summit of Heads of State of the organization, on December 04, 2022.

It is up to us all to fit into this framework by building solid foundations for future generations. The first pillar of this foundation is to draft and adopt a new constitution.

The future constitution must meet the aspirations of the people, stand the test of time and resist the temptations of men. It must also have the ability to adapt to its environment, embrace the great universal principles while preserving our own identity. In short, it must remain strong.

Mister President,

The stakes are high. This is why we are convinced that the principles and values ​​that should prevail in the reflection and drafting of the future constitutional text will be essential for the orientation that we wish to give to our country. In this dynamic, a perfect appropriation by the populations of these principles and these values ​​requires the consideration of our ancestral cultures of solidarity, hospitality, dialogue under the “palaver tree” for a peaceful living together and for the benefit of all.

Also and for the safeguard of the sovereignty of our country, it is imperative that we have a constitution which guarantees our national unity in our diversity, which constitutes a bulwark against any attempt at revision for personal, selfish ends and provides for sanctions against the against the perpetrators of any breaches.

Mister President,

You will agree with us that the elaboration of the conditions of eligibility of our future leaders remains one of the most important tasks of your magisterium because it is also the men who make institutions a strength.

Mister President,

Our future constitution is an opportunity to effectively guarantee fundamental rights relating to education, health, housing, food security for all Guinean citizens and particularly for women and vulnerable people. We would also like to draw your attention to issues related to ecological and climatic issues in general and to the environmental issues of our mining activities. To this end, our texts must clearly state the role and obligations of the State in the preservation and restoration of the national natural environment. The health of our populations, the sustainability of our wealth and the heritage to be bequeathed to future generations are at stake.

Mister President,

It seems urgent to us that to allow the harmonious and balanced functioning of our institutions, the new texts must be more precise on their nature and their areas of competence. In this system, the independence and impartiality of the judiciary must be at the center of your thoughts.

We must be aware that in a context of real socio-economic backwardness of our country, the establishment of a climate of lasting peace becomes essential. We call on your institution to be vigilant in examining the right balance between the legitimate right to exercise public freedoms and the need to preserve social tranquility, public buildings and the safety of people and their property. As for the animation of political life in our country, one can wonder about the relevance of maintaining conditions favoring the proliferation of political parties. Indeed, the Guinean political landscape would benefit from better legislation on the conditions for the creation of political parties in order to invigorate and qualify the political debate and improve the political offer. The issue of their funding and operation must also be addressed.

With regard to elections, the choice to be made between the organization of one or more polls at the same time must take into account a social environment characterized by a low rate of instruction of the electorate on the one hand, and the administrative constraints linked to the identification of citizens on the other hand.

Consequently, the right to education for all is fundamental, as is access to instruction. They must be registered because ignorance is the greatest obstacle to the development of the individual and of society, and a threat to the nation. Victor Hugo summed it up in these two quotes, I quote:

“Every child we teach is a man we win over”; I mean Man has a tyrant, ignorance” end of quotes.

The enjoyment of the civic right to vote must be added to the issuance of adequate documents for the fulfillment of the duty of citizenship. The obligation of this issue of identification documents for Guinean citizens, including those established abroad, must be mentioned.

Concerning the candidates for the various ballots, the principle of fairness must apply for access to electoral means for all eligible candidates.

Finally, the candidates’ good character, probity and republican spirit should be attested.

Mister President,

The establishment of a State capable of accomplishing its missions is one of the objectives sought by the adoption of our constitution. To achieve this, it is essential to have a quality public administration at the service of all our fellow citizens. It is at this price that we will found a State highly capable of ensuring the security and well-being of all, including for Guineans living abroad, for whom the Transitional Authorities are making unprecedented efforts for their repatriation during crises that put them in distress.

In this respect, the functioning of the Public Administration requires reinforced monitoring and control, so that exemplary nature, accountability, neutrality and the notion of public service are imposed on all State agents.

In view of the politicization of the administrative apparatus in the past, I would like to emphasize here the importance of imposing the requirement of neutrality on the public administration, which is supposed to be non-partisan, in order to guarantee social peace, sustainable development and the credibility of the state.

Mister President,

Like any human work, the future constitution with which we will endow our country will be perfectible but will have to withstand the tests of time, economic challenges and above all personal ambitions. Each word and each line that will be laid down in the draft fundamental law will have to be chosen and adopted on the basis of their quality in reinforcing our principles and values, in particular, national unity and social cohesion, justice and respect for human dignity, as well as solidarity and equity.

History will have shown us that the quality of the leaders and senior servants of the State strongly conditions the governance, respect and application of our texts. These personalities will have to be exemplary and accountable in order to be references for our youth. In this regard I quote

CONFUCIUS who said: “Be virtuous and your people will be too. The virtue of a leader is like the wind that blows and the virtue of a people like the grass, when the wind blows the grass lies down in the direction of the wind”.

Beyond words and current practices, the State must truly establish the means of expressing its gratitude to all those, men and women, who have distinguished themselves in sacrifice and service to the Nation or by their contribution to society. This is one of the recommendations that often came up during the meetings organized within the framework of the National Conferences and the Inter-Guinean Inclusive Dialogue Framework.
