UAE Overhauls Higher Education with Sweeping New Decree Law

The United Arab Emirates has enacted a comprehensive federal decree law designed to reshape its higher education and scientific research landscape, aiming to enhance quality, governance, and alignment with future labor market demands. The legislation establishes a robust regulatory framework for all higher education institutions and technical/vocational training centers within the country.
A Framework for Quality and Governance
The decree-law, issued by the UAE government, seeks to establish a “comprehensive federal legislative framework” that will govern the sector, improve institutional management, and boost the competitiveness of higher education offerings. A key objective is to bridge the gap between educational outcomes and the evolving needs of the workforce, while also fostering a culture of lifelong learning for all graduates.
The law applies to all universities and training institutions offering accredited vocational programs exceeding the high school diploma level, operating in accordance with the National Qualifications Framework. It emphasizes the integration of higher education with general education, envisioning a “sustainable future vision” for the nation’s learning ecosystem. Institutions are now obligated to develop innovative, flexible, and proactive study programs that keep pace with technological and scientific advancements.
Unified National Frameworks to Drive Standards
Central to the new law is the implementation of “unified national frameworks” for regulating higher education and scientific research. These frameworks, to be issued by the Council of Ministers following approval from the Education, Human Development and Community Council, will cover critical areas including:
- Institutional Licensing: Establishing standards and conditions for obtaining licenses to operate higher education institutions.
- National Qualifications Framework: Providing a national reference point for structuring qualifications based on knowledge, skills, and responsibilities.
- Performance Classification & Oversight: Implementing indicators and targets to measure and monitor the performance of higher education institutions.
- Scientific Research: Defining priorities, policies, and standards for scientific research within higher education.
- Technical & Vocational Education & Training: Setting standards for institutional accreditation of accredited professional programs.
Local authorities retain the ability to issue their own regulatory frameworks, provided they do not conflict with the overarching national standards.
Strict Licensing and Accreditation Procedures
The decree-law introduces stringent rules for licensing higher education institutions. It explicitly prohibits the establishment or operation of any institution, or the provision of educational services, without first obtaining an institutional license from the Ministry of Higher Education and Scientific Research. Applicants must submit detailed information regarding institutional management, location, academic programs, and financial guarantees.
Furthermore, the law mandates programmatic accreditation for all academic programs. Institutions are barred from offering, promoting, or enrolling students in any program lacking accreditation from the Ministry. Programs with valid international accreditation from recognized bodies may be exempt from repeating the process, provided the international standards meet or exceed national requirements. The decree also reinforces a system for recognizing academic and professional qualifications both domestically and internationally, bolstering confidence in the UAE’s higher education system.
Oversight and Accountability
All licensed institutions will be subject to periodic classification and evaluation by the Ministry, with results published following approval from the Council of Education, Human Development and Society, and the Council of Ministers.
The law also establishes clear obligations for institutions, including obtaining prior approval for significant changes – such as adding or closing academic units or modifying programs – and providing data and access for audits. Institutions must adhere to principles of governance, transparency, risk management, and academic integrity, and embrace digital transformation and sustainable practices.
Special provisions are outlined for higher education institutions operating within free zones, requiring both a local permit and an institutional license, with streamlined procedures for those already holding a local permit.
Penalties for Non-Compliance
The decree-law establishes significant penalties for violations, including imprisonment and fines of up to 10 million dirhams for operating without a license or offering unaccredited programs, or for providing false information to the Ministry.
