Hospital has 48 hours to comment on Jefferson’s stay

The Minister of the Federal Supreme Court, Alexandre de Moraes, sent a subpoena to the direction of Hospital Samaritano, located in the South Zone of Rio de Janeiro. The objective of the document is to clarify the position of the hospital unit in relation to the ongoing treatment of former deputy Roberto Jefferson, after the conflict that arose between the politician and his health plan.

“I determine the immediate subpoena of the director responsible for Hospital Samaritano Botafogo and the defense, so that they can clarify, within 48 (forty-eight) hours, whether – in view of contractual obligations – the custodian will continue to receive treatment at that hospital”, ordered the magistrate .

The problem arose as a result of the position of Roberto Jefferson’s health plan, which said it would no longer assume the costs of his hospitalization at the private hospital. The justification was based on the assessment that the former deputy already had conditions for medical discharge. Due to the absence of official communication from Jefferson’s family about his departure from the hospital, the health plan stopped funding on August 26.

Faced with this situation, the subpoena issued by Minister Moraes aims to determine whether the Hospital Samaritano is willing to continue treating Roberto Jefferson even without receiving payment for the service. If the hospital unit does not agree, the alternative will be the transfer of the former deputy to a public hospital in Rio de Janeiro.

Parallel to the subpoena directed at Hospital Samaritano, Moraes also took measures in relation to the State Government of Rio de Janeiro. Through the State Department of Health, the government was officially asked to indicate a public health unit that is in a position to receive the politician for continuation of his treatment.

“Let the State Secretary of Health, within 48 (forty-eight) hours, indicate the public hospital that, eventually, may receive the person in custody if, under the terms of article 14, paragraph 2 of the LEP, the penal establishment does not equipped to provide the necessary medical assistance”, argued the minister.
