Officials of the Ministry of Education and Science proposed to improve the position of inventors in the Russian Federation and to intensify the introduction of valuable inventions. The draft amendments to the Civil Code deal with the widespread practice of non-use of inventions.
As it became known to MK, it is proposed to amend Article 1373 of the Civil Code of the Russian Federation. The author of an “invention, utility model or industrial design” who has created his creation at a state or municipal research institute or university will be entitled to demand the transfer of exclusive rights to his creation to him if the research institute or university has not started its implementation within two years after obtaining the rights to him.
However, a research institute or university has the right not only to start implementing the invention itself, but also to transfer the right to use it to another person under a license agreement. A two-year period seems to the authors “sufficient” for a practical step.
